172. Artificial light.

Artificial light emitted from premises1 so as to be prejudicial to health2 or a nuisance3 constitutes a statutory nuisance4, except:

  1.  

    (1)     in relation to premises:

    1.  

      (a)     occupied on behalf of the Crown for naval, military or air force purposes or for the purposes of the department of the Secretary of State having responsibility for defence5; or

    2.  

      (b)     occupied by or for the purposes of a visiting force6; and

  2.  

    (2)     in relation to artificial light emitted from:
