In granting or modifying a scheduled monument consent1 in the cases listed below, the Secretary of State or, in relation to Wales, the Welsh Ministers2 may do so on terms that no works3 in respect of which compensation was paid4 are to be executed in pursuance of the consent until the recoverable amount5 has been repaid to or secured to the Historic Buildings and Monuments Commission for England ('the Commission')6 or secured to its satisfaction7 or, as the case may be, repaid to the Welsh Ministers or secured to their satisfaction8.
