1029. Meaning of 'ancient monument'.

'Ancient monument' means:

  1.  

    (1)     any scheduled monument1; and

  2.  

    (2)     any other monument2 which in the opinion of the Secretary of State or, in relation to Wales, the Welsh Ministers3 is of public interest by reason of the historic, architectural, traditional, artistic or archaeological interest attaching to it4.

In addition, references to an 'ancient monument' in the provisions relating to the acquisition5 and guardianship6 of ancient monuments include references to any land7 adjoining or in the vicinity of an ancient monument which appears to the Secretary of State or the Historic Buildings and Monuments Commission for England ('the Commission')8 in relation
