The general responsibility for maintaining Apsley House1 lies with the Secretary of State2, subject to a duty placed on the Duke of Wellington for the time being to keep the portions of the house which he is entitled to occupy3 in good and tenantable repair and to maintain the garden4. If any of the Dukes of Wellington fails to comply with the obligation so imposed on him, the Secretary of State, on giving reasonable notice of his intention to do so, may himself do such repairs to the portions of Apsley House
