The requirement to give an operations notice1 does not apply to any operations2 carried out with the consent of the investigating authority3 for the area of archaeological importance4 in question5; nor to the carrying out of any operations for which development consent has been granted6.
The Secretary of State or, in relation to Wales, the Welsh Ministers7 may by order8 direct that the requirements are not to apply to the carrying out, or to the carrying out by any class or description of persons
