The Historic Buildings and Monuments Commission for England ('the Commission')1, where the monument2 in question is situated in England3, or the Welsh Ministers, where the monument is situated in Wales4, must pay compensation5 to any person who has an interest in the whole or any part of a monument and who incurs expenditure or otherwise sustains any loss or damage in consequence of the refusal, or the granting subject to conditions, of a scheduled monument consent6 in relation to any of the following7:
(1) works8 which are reasonably necessary for carrying out any development9 for which planning permission10 had been
