The Historic Buildings and Monuments Commission for England ('the Commission')1 has power2, subject to the consent of the Secretary of State3, to acquire by agreement, whether by purchase, lease or otherwise, or to accept a gift4 of:
(1) any building which is situated in England5 and which appears to the Commission to be one of outstanding historic or architectural interest6;
(2) any building which is situated in England and in an area designated as a conservation area7 and which appears to the Commission to be of special historic or architectural interest8;
(3) any land which is situated in England
