311. Trustees' right of redemption in respect of land held on trust.

Where land is held on trust, the trustees represent the beneficiaries and have in relation to the land subject to the trust the powers of an absolute owner, including the power to redeem a mortgage1. This includes the case of an express trust, a former trust for sale2 or a purported settlement created after 1 January 19973, and a trust which arises where land is conveyed to two or more persons as joint tenants or tenants in common
