If probate is granted to one or some of two or more persons named as executors, a mortgage of real estate1 may be made by the proving executor or executors and is as effectual as if all the persons named as executors had concurred therein2, but otherwise neither a legal nor an equitable mortgage of real estate can be made without the concurrence of all the personal representatives or a court order3.
