499. Nature of mortgagor's remedy for loss of title deeds.

Upon redeeming, the mortgagor is entitled to a discharge and to delivery of the title deeds and writings relating to the property, including copies1, and if they have been lost he is justified in instituting proceedings for redemption2 in order that the fact of the loss may be ascertained for the satisfaction of future purchasers. In such proceedings, the mortgagee is directed to give an indemnity against the consequences of the loss of the deeds, and he is liable to pay the costs
