397. Mortgagee's right to restrain conduct prejudicing security.

Apart from the doctrine of waste1, the mortgagee is entitled to restrain the mortgagor from conduct which would prejudice the mortgage security2. Upon a mortgage of goods where the mortgagor retains the right of possession until default, an improper sale by him determines his right, and gives the immediate right to possession to the mortgagee who can then sue for conversion
