In foreclosure proceedings the mortgagee's costs are not, in the absence of special circumstances, payable by the mortgagor personally; the mortgagee adds them to his debt, and the mortgagor only pays them if he redeems1. Moreover, the mortgagee is not liable in general to pay the costs of any other party to the proceedings2. A defendant who disclaims interest is, however, entitled to his costs if he has been needlessly made a party to the proceedings, or to costs subsequent to disclaimer if the proceedings
