A contract made before 27 September 19891 for the mortgage of land or an interest in land2, except a mortgage by deposit of title deeds3, is not enforceable unless a memorandum or note of it was made in writing and signed by the party to be charged with it or some person lawfully authorised by him to do so4, or unless there has been part performance of the contract sufficient to take it out of the statutory requirement as to writing5
