In proceedings for possession of the mortgaged property, the claim form must be in the prescribed form1. There are also prescribed forms for the particulars of claim2 but the rules permit these forms to be varied by a party if the variation is required by the circumstances of a particular case3. A form must not be varied so as to leave out any information or guidance which the form gives to the recipient4. The particulars of claim must be filed and served together with the claim form5.
