In relation to leases granted before 1 January 19961, the relationship of lessor and lessee is not affected by a mortgage, so that the lessee remains liable to perform the covenants whether or not a mortgagee takes possession2.
In relation to tenancies granted on or after 1 January 1996, where any landlord covenant3 of a tenancy is enforceable against the reversioner in respect of any premises demised by the tenancy, it is also enforceable against either any person (other than the reversioner) who, as the holder of the immediate reversion
