The following provisions apply where a local authority1 proposes to carry out works on any land for the purposes of (1) reclaiming or improving land under which relevant operations2 have been, but are no longer being, carried out; or (2) enabling it to be brought into use3.
If the following conditions are fulfilled, the authority may carry out the works without the consent of persons interested in the land4, notwithstanding the provision5 requiring such consent6. The conditions are that (a) in the authority's opinion the surface of the land under which the relevant operations have been carried out has collapsed
