The owner1 of a mine2 or quarry3 to which provisions of the Clean Air Act 1993 apply4 must employ all practicable means5 for preventing combustion of refuse deposited from the mine or quarry; and for preventing or minimising the emission of smoke6 and fumes7 from such refuse; and if he fails to do so, he is guilty of an offence8. A person9 guilty of such an offence10 is liable on summary conviction to a fine not exceeding level 5
