Subject to certain provisions1, a person duly authorised in writing2 by a local authority3 may at any reasonable time enter upon the land on which a disused tip4 is situated, or upon any neighbouring land, for the purpose of: (1) investigating whether any instability5 of the tip might constitute a danger to members of the public6; (2) carrying out operations7, referred to as 'exploratory tests'8, to determine whether the tip is unstable9; and (3) inspecting any operations being carried out on that land where those operations may affect the stability of the tip10.
