Where the person with responsibility for subsidence affecting any land1 takes any remedial action2, or makes any payment to, or makes any living accommodation available to, any person3, he must also pay any costs or expenses reasonably incurred by the claimant4 or any other person interested5 or by the person in question (1) for the preparation and prosecution of his damage notice6 or claim7; or (2) in the case of costs or expenses incurred by the claimant before the subsidence damage8 became evident, with a view to the possible preparation and prosecution of his damage notice9.
