The Secretary of State1 was empowered by the Coal Industry Nationalisation Act 1946 to make regulations for the purpose of providing pensions, gratuities and other like benefits for certain persons employed in or about the coal industry2. The British Coal Superannuation Scheme3 and the Mineworkers' Pension Scheme4 were approved under such regulations. In connection with the restructuring of the British Coal Corporation's undertaking5, the Coal Industry Act 1994 makes provision in relation to the pensions paid to or in respect of its present and former employees and other persons
