Where the mining code of the Railways Clauses Consolidation Act 18451 or the mining code of the Acquisition of Land Act 1981 applies2, if any minerals3 have been worked or are being worked contrary to the mining code or the special Act of a railway authority, the railway or other authority may give notice to the mine owner4 requiring him to construct such works and to adopt such means as may be necessary or proper for making safe the railway or works and for preventing injury to them;
