Where, under any provision of the Mines (Working Facilities and Support) Act 1966, the Secretary of State1 refers any application to the High Court, he must file a reference signed by him or a person authorised to sign on his behalf in the Chancery Division of the High Court2, together with any documents and plans deposited with him by the applicant in support of his application3 and within three days of filing the reference, give notice to the applicant that the reference has been filed4.
Within ten days after receipt of that notice5 the applicant must issue a claim form
