Where the conclusion reached by a geotechnical specialist1 as to the safety and stability of the proposed or existing excavation2 or tip3 being assessed4 following a geotechnical assessment5 is that it presents no significant hazard6, the operator7 must ensure that:
(1) the geotechnical specialist specifies the frequency with which appraisals8 are to be conducted in order to ensure the continued safety and stability of the excavation or tip9; and
