In relation to any:
(1) proposed excavation1 or tip2 which it is reasonable to expect will be a significant hazard3;
(2) notifiable excavation4; or
(3) notifiable tip5 other than a notifiable tip which was a classified tip6, and in respect of which the relevant notice has been given7,
the operator8 of a quarry9 must10 give not less than 30 days' notice11 (or such shorter period as the Health and Safety Executive12 may permit) to the Health and Safety Executive of his intention to commence or, in relation to excavations and tips falling within heads (2) and (3) above, continue, operations13.
