If it appears to a local authority1 that a disused tip2 situated wholly or partly within its area is unstable3 and for that reason constitutes or is likely to constitute a danger to members of the public, the authority may by notice in the prescribed form4 served5 on the owner6 require him to carry out, within a specified period7, such remedial operations8 as may be specified in the notice9. The notice may require such operations to be carried out on the tip itself, on the land on which it is situated or on any neighbouring land in the occupation
