For the purpose of facilitating the working of coal by opencast operations1, the Coal Authority2 has power, by means of a compulsory rights order3 made by the Authority and confirmed by the appropriate national authority4, to confer5 temporary6 rights of occupation and use of the whole, or such part as, subject to the confirmation of the appropriate national authority, the Authority thinks fit, of any land7 on which the applicant for the order desires to work coal by such operations or to carry out operations incidental to such working8.
