The power to modify an existing scheme1 by regulations2 has not been exercisable since the end of the period of two years beginning with the restructuring date3. Before making any regulations in relation to an existing scheme the Secretary of State4 had to consult with the British Coal Corporation5 and the trustees for the time being of that scheme6. The power did not authorise the making of any modification7 which, in relation to the person entitled to it, adversely affected so much of any pension right8 as gave rise to any of the principal pension obligations9 under that scheme10.
