'Instroke' means liberty to work a demised mine1 from an adjoining mine. In the absence of express stipulation a lessee is not bound to sink a shaft from the surface, but may work by instroke2, and may make use, for that purpose, of apertures lawfully made in any barrier which he has covenanted to leave between the demised mine and adjoining mines3.
