While his mine1 is being worked, and without paying compensation to the landowner or occupier, the miner is entitled to a right of way (limited to purposes and persons connected with the mine) from the mine to the nearest highway, and also to the nearest stream, spring or natural pond, and to take water from it2.
Similarly, without payment of compensation to the landowner or occupier, he is entitled to the exclusive use of such surface land as is thought necessary by the barmaster for the purposes of working the mine3, but he is not entitled to use surface land
