Where the mining code of the Railways Clauses Consolidation Act 18451 or the mining code of the Acquisition of Land Act 1981 applies2, the railway or other authority purchasing land3 is under no necessity to lay out funds at the outset on the purchase of support from minerals4 within the area of protection5: it may postpone such outlay until the mine owner desires to work the minerals6. The railway or other authority has no rights of subjacent or adjacent support from the minerals within the area of protection until and unless such support is acquired either by the purchase
