The obligation to comply with an enforcement order1 is a duty owed to any person who may be affected by a contravention2 of the order3. Any breach of this duty which causes the person to whom it is owed to sustain loss or damage is actionable against the person in breach at the suit or instance of that other person4. In any such proceedings it is a defence for the person by whom the duty is owed to show that he took all reasonable steps and exercised all due diligence
