In default of agreement, any land drainage question1 arising between the responsible person2 and the appropriate drainage authority3 is to be referred to and determined by an arbitrator agreed for that purpose or, in default of such agreement, appointed by the President of the Institute of Civil Engineers4.
Where either the appropriate drainage authority or the responsible person so requests5, any question as to the reasonableness of any requirement to carry out remedial measures6, or the timing of those measures, must be referred to and determined by the Secretary of State
