303. Contracts not specifically enforceable.

The court will not normally grant specific performance of a contract to sell minerals to be obtained from a mine1, for this is a contract for the sale of chattels2 and would involve the superintendence by the court of the working of the mine3. Similarly, in the normal course the breach of a contract to sell chattels will not be restrained by mandatory injunction4. For the same reasons a contract to work a quarry will not be specifically enforced5.

The right to specific performance of a contract may be barred by laches6. Delay is not a bar while both parties
