Where (1) the land comprised in a compulsory rights order1 consists of or includes land which immediately before the date of entry2 constituted or formed part of a holding to which the provisions of the Landlord and Tenant Act 1927 relating to compensation for improvements and goodwill on the termination of business tenancies3 apply4, and on which before that date improvements qualifying for compensation5 had been carried out6; and (2) the tenancy7 under which the tenant could have claimed compensation for the improvements
