33.     Claim for an account.

A claim may be maintained for an account of minerals wrongfully abstracted1. In such a claim the defendant is required to account for the value of the mineral raised, that is to say the market price or value after making just allowances2. When a mine3 is held in trust for co-owners, one of the equitable co-owners who has not consented to the grant by the others of a licence to work may have an account against the licensee4.

Such a claim for an account is available not
