Where, in the case of any subsidence damage1, the area of responsibility2 of any person as holder3 of a licence under Part II of the Coal Industry Act 19944 includes only part of the damaged land5 or, as the case may be, of the land where the damaged property6 was situated, then the responsible persons in relation to that damage are that person, together with every other person within whose area of responsibility any part of that land is situated, and if any part of that land
