An application for a licence1 may be made by any person who has acquired, or is proposing to acquire (whether from the Coal Authority2 or some other person) (1) such an interest3 in land comprised in the area with respect to which the application is made; or (2) such rights in relation to coal4 in that area, as, apart from the need5 for a licence, would entitle him to carry on the coal-mining operations6 to which the application relates7.
