563. Appeals against notices requiring remedial operations.

A person on whom is served a notice1 or copy of a notice2 requiring remedial operations3 may apply4 to the court5, within a specified period6 and on specified grounds7, for an order varying or cancelling the notice8.

The specified grounds are: (1) that there is no reasonable ground for believing that the tip is unstable9 or that, by reason of instability it constitutes or is likely to constitute a danger to members of the public10; (2) that the remedial operations specified in the notice are more extensive than is necessary to secure the safety of members of the public11; (3)
