If the right to work minerals1 is granted for a term of years, the right is not waived or abandoned during the term, even where the grantee has ceased working for many years2. A presumption of right arises from possession3 apart from the Limitation Act 1980, 4but the title to minerals will be extinguished if possession is abandoned by the owner and another has actual possession for the statutory period5.
