An order appointing an acting nearest relative1 made in respect of a patient2 by the county court3 may be varied by that court, on the application4 of the patient or of the person having the functions of the nearest relative by virtue of the order or on the application of an approved mental health professional5, by substituting another person for the person having those functions6.
If the court decides to vary an order on such an application, the following rules have effect for the purposes of substituting another person:
(1) if a person is nominated in the application to act
