Nothing in the Mental Capacity Act 2005 authorises anyone to give a patient medical treatment1 for a mental disorder2 or to consent to a patient's being given medical treatment for a mental disorder, if at the time when it is proposed to treat the patient, his treatment is regulated by Part 43 of the Mental Health Act 19834.
