Certain statutory functions relating to mental health and mental capacity are exercisable by the Secretary of State1 (in relation to England) and the Welsh Ministers (in relation to Wales)2. The functions exercisable by the Welsh Ministers are:
(1) functions originally transferred to the National Assembly for Wales3 by Order in Council and subsequently transferred to the Welsh Ministers4;
(2) functions originally conferred on the National Assembly for Wales by enactments made after the establishment of that body and subsequently transferred5 to the Welsh Ministers6;
(3) functions transferred to the Welsh Ministers by Order in Council
