A person who escapes from legal custody1 may be retaken by the person who had his custody immediately before his escape, or by any constable or approved mental health professional2. If at the time of the escape the person escaping was liable to be detained in a hospital3 or under guardianship4 or a community patient who was recalled to hospital5 he may also be retaken by any other person who could take him into custody6 if he were absent without leave7; but he may not be retaken by any person after the expiration of the period8 within which he
