If a person is serving a sentence of imprisonment1, and the Secretary of State2 is satisfied, by reports3 from at least two registered medical practitioners4: (1) that that person is suffering from mental disorder5; and (2) that the mental disorder6 from which the person is suffering is of a nature or degree which makes it appropriate for him to be detained in a hospital7 for medical treatment8; and (3) such appropriate medical treatment is available for him9, then if the Secretary of State is of the opinion having regard to the public interest and all the circumstances that it
