723.     Power to make declarations.

The Court of Protection1 may make declarations2 as to:

  1.  

    (1)     whether a person has or lacks capacity3 to make a decision specified in the declaration4;

  2.  

    (2)     whether a person has or lacks capacity to make decisions on such matters as are described in the declaration5;

  3.  

    (3)     the lawfulness or otherwise of any act6 done, or yet to be done, in relation to that person7.
