Part 4 of the Mental Health Act 19831 makes provision as to a patient's2 consent to treatment. It applies to any patient liable to be detained3 except where he is detained4;
(1) under the provisions relating to an emergency application for assessment5;
(2) under the provisions relating to temporary detention of an in-patient following a report by either the registered medical practitioner6 or approved clinician7 in charge of the patient's treatment or by a nurse of the prescribed class8;
(3) under the provisions relating to a remand to hospital for report9;
(4) under the provisions relating to a removal
