A 'registered establishment' means an establishment which would not, apart from certain provisions1, be a hospital for the purposes of the Mental Health Act 1983 Part 22 and which:
(1) in England, is a hospital as defined by the National Health Service Act 20063 that is used for the carrying on of a regulated activity4 which relates to the assessment or medical treatment of mental disorder and in respect of which a person is registered
