605. Inability to make decisions.

A person is not to be treated as unable to make a decision unless all practicable steps to help him to do so have been taken without success1 and a person is not to be treated as unable to make a decision merely because he makes an unwise decision2.

For the purposes of deciding whether a person lacks capacity3 a person is unable to make a decision for himself if he is unable4:

    (1)     to understand the information relevant to the decision5;

  2.  

    (2)     to retain that information6;

  3.  

    (3)     to use or weigh that information as part of the process of
