The Mental Health Act 19831 prescribes a single code under which patients2 in need of treatment for mental disorder3 may be compulsorily admitted to and detained in4 any hospital5 or a registered establishment6 or received into the guardianship7 of a local social services authority8 or other person9. The Act also provides for courts in criminal proceedings to make orders for admission to hospital or guardianship orders in respect of people suffering from mental disorder10, for the treatment of patients whilst in the community11 and for the transfer to hospital of certain prisoners and other persons liable to be detained12.
