An order appointing an acting nearest relative made1 in respect of a patient2 by the county court3 may be discharged by that court on the application4 of (1) the patient or the person having the functions of the nearest relative by virtue of the order5; (2) where the order was made on the ground that the patient had no nearest relative or that it was not reasonably practicable to ascertain whether he had such a relative, or who that relative was6, or that the nearest relative of the patient is incapable
